Bounce Conditional Use application pulled - WE CANNOT LET OUR GUARD DOWN!


Here's the letter from the lawyer representing the Bounce nightclub, requesting the withdrawal of their application for the 2:00am Conditional Use from the Commission meeting agenda on February 1. Their action is attributed to “the outpouring of community feedback”.  In other words, the large majority of Delray residents do NOT want Conditional Use for Bounce or any other establishment operating a late night hard-partying club outside the established Entertainment District.

Thank you all for your strong support on this critical issue!  Your combined efforts, letter writing and personal grievances have been heard - loud and clear.  We must also recognize those Commissioners who had already indicated that their vote would be influenced by the strong opposition from local residents.

Bounce pulling the application certainly feels like we "won the battle", but there’s no guarantee that we "won the war”.  Given Bounce’s prior aggressive tactics and propaganda, it’s very likely that they will continue their lawyering and lobbying and re-apply for conditional use at a later date - regretfully, they may try to bounce back. 
Based on miscellaneous information we’ve gathered, we are starting to speculate that Bounce may just be a “front” for some much bigger out-of-town investments targeting the development of East Atlantic, between the Intracoastal and A1A.    
So, we will remain diligent and we hope that we can count on your energy and conviction to continue our campaign to “save Delray".

For reference, the January 1 Bounce community information session at the Opal Hotel was another attempt to “put lipstick on a pig”, as some called it.  Their plans and claims did not seem credible and their motives remain questionable… with all their smoke and mirrors, it is clear that they want to be a NIGHTCLUB, not a restaurant.  Even the Q&A session was nothing more than a couple of blatant, scripted propaganda statements from a few “plants”.  

We cannot let our guard down!

Based on the outpouring of community feedback related to our application, my client would like to withdraw this application from consideration from tomorrow’s noticed City Commission meeting to be heard at a properly noticed meeting in the future. My client will pay for the new notices required by this withdrawal from the February 1, 2022 agenda.
